Terms and Conditions

These terms are an agreement between you and Customer Experience Insight Pty Ltd trading as WA AI Hub (ABN 61 634 039 759) (we, us) for your use of AIEdu at aiedu.quest (the Service). They include our Privacy Policy, Refund Policy, Children’s Privacy Policy and How we use AI. By creating an account, subscribing or using the Service you accept them. If you do not accept them, do not use the Service.
1. Your consumer rights come first
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) (ACL). For a major failure you are entitled to cancel and receive a refund (or compensation for the reduced value), and to compensation for other reasonably foreseeable loss or damage; for a minor failure we may choose to fix it within a reasonable time. Services must be provided with due care and skill, be fit for any purpose we have told you about, and be supplied within a reasonable time. Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or condition, implied or imposed by the ACL or any other law that cannot lawfully be excluded or limited. If you are a consumer in the European Union or elsewhere, any mandatory consumer-protection rights of your country of residence also continue to apply. Where a term here conflicts with those rights, those rights prevail.
2. Who can use the Service
- You must be at least 18 years old to create an account, subscribe, join a team or earn a certificate. The Service is not directed at children (see the Children’s Privacy Policy).
- If you use the Service for an organisation, you confirm you have authority to bind it, and “you” includes it.
- You must provide accurate information and keep it up to date.
3. Your account
Keep your sign-in details secure and tell us at once if you suspect unauthorised use. You are responsible for activity under your account except where it results from our failure to take reasonable care. Multi-factor authentication is not currently offered; use a unique password or the email sign-in link. You may download your data or permanently delete your account yourself at any time under Account → Your data (deleting cancels any subscription immediately; see the Refund Policy), or by emailing us. We keep a record of the Terms version and 18+ confirmation you accept at sign-up.
4. Plans, prices and payment
- Free: the free assessment and modules described on the Pricing page, with no payment.
- Pro (monthly or yearly) and Team (per seat, minimum seats apply): paid features described on the Pricing page when you subscribe. We describe features accurately; we may add or improve features but will not materially reduce the paid features you have paid for during a paid period.
- Prices are in Australian dollars and include GST where GST applies. The total price, billing period and renewal terms are shown before you pay at Stripe’s hosted checkout.
- Payment is taken by Stripe. By subscribing you authorise recurring charges to your chosen payment method until you cancel. We do not receive or store your card details.
- If a payment fails, we or Stripe may retry it and notify you; paid access is suspended automatically until the payment is resolved, and your free access and data are unaffected.
- You are responsible for any bank or currency-conversion fees charged by your provider.
5. Automatic renewal and cancellation
- Subscriptions renew automatically for the same period (monthly or yearly) at the then-current price until you cancel.
- We will email you at least 30 days before any price increase or change to renewal terms takes effect on your subscription, and you may cancel before then without penalty. A change never applies to a period you have already paid for.
- Cancel any time under “Manage billing” in your account (the Stripe customer portal) or by emailing us. Cancellation takes effect at the end of the current paid period; you keep paid access until then and are not charged again. There is no cancellation fee and no lock-in.
- Refunds are governed by our Refund Policy, which includes a 14-day money-back guarantee for first-time subscribers.
6. AI features, scores and certificates
- The Service uses third-party AI models to score submissions, give feedback, tutor, draft path text and translate. AI output can be inaccurate, inconsistent or biased. It is provided for learning only and is not legal, financial, employment, medical or other professional advice. Check it before relying on it.
- Do not submit personal, confidential, client or sensitive information of anyone to AI features; it is sent to AI providers, including in the United States (see the Privacy Policy).
- Certificates are issued automatically by fixed published criteria (see How we use AI). A certificate says only that those criteria were met within AIEdu; it is not an accredited qualification or an endorsement by any regulator, employer or institution.
- Human review. You may ask for a person to review any score, certificate or access decision and to correct it. Email us; a person not involved in the original outcome will reply within 10 business days.
6A. Intended use and prohibited high-risk uses
AIEdu is a self-directed learning and workplace-upskilling tool for individual adults. Its scores and certificates are not designed, tested or validated for any of the following, and you must not use the Service, or any score, feedback or certificate from it, for them:
- deciding admission to, access to, or placement within an education or vocational training institution or course;
- formally assessing or grading students or evaluating learning outcomes for an institution, or steering a student’s learning on an institution’s behalf;
- monitoring or detecting prohibited behaviour of students during tests (proctoring);
- recruitment, selection, promotion, task allocation, discipline, termination or other decisions about workers or job applicants;
- credit, insurance, essential public or private services, law enforcement, migration or any other use listed as high-risk in Annex III of the EU Artificial Intelligence Act (Regulation (EU) 2024/1689) or its Australian equivalents; or
- any practice prohibited by Article 5 of that Act (for example social scoring or emotion recognition at work or school).
Education providers, registered training organisations and similar institutions, and employers, may use AIEdu only for optional, informal learning by individuals, not as an input to any such decision. Any other use requires our prior written agreement, which we will give only after a documented review of the legal and risk requirements that would then apply. We may suspend access for use that breaches this section.
7. Acceptable use
You must not:
- break the law or infringe anyone’s rights through the Service;
- submit another person’s personal information without a lawful basis, or unlawful, harmful or abusive content;
- attempt to extract answer keys or prompts, scrape, overload, probe or bypass security, rate limits, quotas or access controls;
- share your account, resell the Service, or misrepresent a certificate or score; or
- use scores or certificates as the sole basis for decisions about a person (see section 9).
If you seriously or repeatedly breach this section we may, after warning you where practicable, suspend or end your access. If we end a paid subscription for reasons other than your serious breach, we will refund the unused part of the paid period.
8. Content and intellectual property
- We and our licensors own the Service, its software, design, questions, cases, rubrics and content. We grant you a personal, non-exclusive, non-transferable, revocable licence to use it for your own learning (or, on a Team plan, your team’s learning) while these terms apply. AIEdu and its logo are trademarks of Customer Experience Insight Pty Ltd.
- You keep ownership of what you submit. You give us a non-exclusive, worldwide licence, for as long as needed, to host, process and transmit it (including to our AI providers) solely to provide, secure and improve the Service and as described in the Privacy Policy. You confirm you have the right to submit it.
- Output generated for you may not be unique and may resemble output generated for others. Subject to law and third-party terms, you may use output for your own purposes.
9. Team plans
- The team owner must tell members, before inviting them, what the team view shows. Members’ pillar scores appear in the manager view only if the member opts in, and members can opt out at any time. Prompts and individual answers are never shown to managers.
- Owners and managers must not use scores or certificates as the sole basis for decisions about hiring, promotion, discipline or termination, and must comply with applicable employment, discrimination and privacy laws (including the Equal Opportunity Act 1984 (WA)).
- The team owner is responsible for fees for all seats and for removing departed members.
10. Availability and changes to the Service
We take reasonable care to keep the Service available and secure but do not promise it will be uninterrupted or error-free; we may suspend it briefly for maintenance. We may change, add or retire free features. If we remove a paid feature in a way that materially reduces what you paid for, you may cancel and we will refund the unused part of your paid period.
11. Disclaimers and limits on liability
- Subject to section 1, and to the extent the law allows, we exclude all other conditions and warranties, and we are not liable for loss of profit, revenue, goodwill or data, or for indirect or consequential loss, and for the free parts of the Service we provide them “as is”.
- Where a consumer guarantee is not excludable but the law allows us to limit liability, our liability for breach is limited, at our option, to supplying the services again or paying the cost of having them supplied again.
- Subject to section 1, our total liability to you for all claims in connection with the Service in any 12-month period is limited to the greater of the fees you paid us in that period and A$100.
- Nothing limits liability for fraud, death or personal injury caused by negligence, or anything that cannot be limited by law (including under EU mandatory consumer law).
- We are not responsible for third-party sites, providers or services outside our reasonable control, but we remain responsible for our processors’ handling of your personal information as set out in the Privacy Policy.
12. Ending these terms
You may stop using the Service and close your account at any time. On closure we handle your data as set out in the Privacy Policy. Sections that by nature should survive (including intellectual property, liability and governing law) survive termination, as do accrued rights and your statutory rights.
13. Changes to these terms
We may update these terms for legal, security, operational or product reasons. For material changes we will give account holders at least 30 days’ notice by email or in the Service before they apply. A change that is adverse to you will not apply to a period you have already paid for, and if you do not accept it you may cancel and receive a refund of the unused part of your paid period. Continued use after the effective date means you accept the update.
14. Complaints, disputes and governing law
- Tell us first at privacy@wahub.ai. We will acknowledge within 7 days and aim to resolve within 30 days.
- If unresolved, you may contact Consumer Protection (WA), the ACCC, or the OAIC for privacy matters, or (in the EU) your national consumer authority. Nothing stops you going to a court or tribunal.
- These terms are governed by the laws of Western Australia, Australia. Subject to your mandatory rights as a consumer to bring proceedings in your home courts, each party submits to the non-exclusive jurisdiction of the courts of Western Australia.
15. General
- Entire agreement: these terms and the policies they refer to are the whole agreement about the Service.
- Severability: an unenforceable provision is read down or removed and the rest continues.
- No waiver; assignment: a delay in enforcing a right is not a waiver. We may transfer our rights to a successor who takes on our obligations; you may not transfer yours without our consent.
- Events beyond control: neither party is liable for delay caused by events beyond its reasonable control, but this does not affect your refund rights.
- Notices: we may give notices by email to your account address or within the Service. Contact us at privacy@wahub.ai.
- Language: the English version governs; translations are provided for convenience only.
