Children’s Privacy Policy

This policy explains how Customer Experience Insight Pty Ltd trading as WA AI Hub (ABN 61 634 039 759) treats children’s personal information on AIEdu. It supplements our Privacy Policy and applies in Western Australia, elsewhere in Australia and, for anyone in the European Union, in line with the GDPR. In this policy a child is anyone under 18 (the Australian and EU definition for protective purposes).

1. AIEdu is for adults

  • AIEdu is designed for working adults and professionals. It is not directed at, designed for or marketed to children, and we do not offer it to schools or school-age students as a service.
  • You must be 18 or older to create an account, subscribe, join a team, earn a certificate or provide an email address on the waitlist. We ask you to confirm this when you create an account.
  • Under 13s must not use the Service at all. We do not knowingly collect information from anyone under 13 (the threshold in the US COPPA rule, which also reflects our US-based AI providers).
  • We do not sell, advertise to, profile, track across sites, or use dark patterns on anyone we know to be a child, and we do not use children’s data to train AI models.

2. Why 18+, and what the law says

  • Australia (including WA): A minor’s capacity to enter a binding subscription contract is limited, and the Privacy Act guidance expects consent from a parent or guardian for young people who lack capacity (generally under 15). Setting 18+ avoids any doubt. The OAIC’s Children’s Online Privacy Code (being made under the Privacy and Other Legislation Amendment Act 2024) will apply to online services likely to be accessed by children; because we are adult-only with an age confirmation, we do not expect to be covered, and will review this when the Code takes effect.
  • EU: GDPR Art 8 requires parental authorisation for information-society services offered to children below the age set by each Member State (13–16). We do not offer the Service to children, and we apply Recital 38 (children merit specific protection) by setting the age at 18 and applying data minimisation.
  • Consumer law: We follow the ACL and EU rules on fairness to vulnerable consumers by not selling to people we know are under 18.

3. How we keep children out

  • An 18+ confirmation (and acceptance of our Terms) is required before an account is created.
  • Paid plans are bought only through Stripe by an account holder who has confirmed they are 18+; we do not accept payments we know to be made by a child.
  • We collect only what is needed (data minimisation), and we do not ask for date of birth, school, or any information that identifies a person as a child.
  • Free-text AI features warn users not to submit personal information of anyone, including children, and we will delete such information on request.
  • No social features: there is no public profile, chat or user-to-user messaging.

We acknowledge that an age confirmation cannot stop every child from using the free, no-account features. We do not consider that these features collect more than anonymous learning data, and our response below applies if we learn a child has used them.

4. If we learn a child’s information has been collected

  • We will stop using the information, delete the account and associated personal information (and ask our processors to do the same) within 30 days of becoming aware, unless the law requires us to keep it.
  • We will refund any payment made by or for a child, in full, regardless of the usual refund periods.
  • If a breach affects a child’s information we will assess it under the Notifiable Data Breaches scheme (and GDPR Arts 33–34 where applicable) with particular weight given to the child’s vulnerability.

5. Parents and guardians

If you are a parent or guardian and believe your child has given us personal information, email privacy@wahub.ai. We will verify your relationship in a way that does not collect more information than necessary, tell you what we hold, and delete it. You may also complain to the OAIC (oaic.gov.au), the eSafety Commissioner for online safety concerns (esafety.gov.au), or, in the EU, your local data protection authority.

6. Schools, universities and training organisations

We do not currently offer AIEdu for use by or with students under 18. If an organisation wishes to use it with learners who may be under 18, it must first contact us; we will only agree after a written agreement, a privacy impact assessment and appropriate parent/guardian consent and notice arrangements are in place, and this policy will be updated.

7. Review

We review this policy at least annually and when the Children’s Online Privacy Code, the Privacy Act or EU law changes. See also our Terms and Conditions.
